What about the roadblock - checkpoints themselves? Not since the fall of the Soviet Union have check points been so widely accepted as they have been here, in the United States of America. As citizens have become more aware of their rights concerning 'Probable Cause' for search and seizure, legislators have responded by passing additional laws involving further violations of your Constitutional Rights. Rather than arguing the Constitutionality of random roadblocks, a new type of roadblock simply requires an officer to claim that 'he' did not observe a seat belt. This allows law enforcement to invade your personal vehicle to claim further possible infractions i.e., the smell of alcohol. |
